INFORMATION ON PROCESSING OF PERSONAL DATA

Operating under the Partners of Tomorrow brand, IDEA Moda Konf.San.Ve Tic.Ltd Şti. has the title of “data controller” within the scope of the Personal Data Protection Law No. 6698 (KVKK). This text has been prepared in order to inform about the personal data processing activities carried out in accordance with Article 10 of KVKK.

What are your personal data processed?

Your personal data is collected by our Company through different channels in order to carry out our activities and based on the legal reasons of ensuring compliance with the legislation and Company policies. Your personal data may be processed and transferred in accordance with the basic principles stipulated by the KVKK, within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK, and for the purposes specified in this Disclosure Text. In this context, the following personal data is processed.

 

Identity information (name-surname, place of birth, date of birth, age, Turkish ID number, etc.), contact information (e-mail address, telephone number, mobile phone number, address), personal data processed for the purpose of ensuring the technical, administrative, legal and commercial security of our Company and the relevant parties (e.g. information such as the website password and passcode that match the transaction associated with the personal data owner and that shows that the person is authorized to perform that transaction), personal data processed to manage the commercial, technical and administrative risks of our Company (e.g. IP address, Mac ID, etc. records), financial information regarding payment and health records for our employees are processed within the scope of personal data.

 

Reasons for Processing Personal Data :

Your personal data collected is processed in accordance with the basic principles set forth by the KVKK and within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK.

  1. To be able to carry out work and transactions as a result of signed contracts and protocols.
  2. To ensure the fulfillment of legal obligations as required or made mandatory by legal regulations.
  3. To carry out human resources processes.
  4. To ensure corporate communication.
  5. To ensure the security of the institution,
  6. To be able to do statistical studies.
  7. To establish contact with real/legal persons who have business relations with the institution.
  8. To make legal reports.
  9. The burden of proof as evidence in legal disputes that may arise in the future

Our Method of Collecting Personal Data

Personal data is collected by fully or partially automatic means or non-automatic means provided that it is part of any data recording system. We would like to state that permission is obtained for all types of personal data processing, except for cases where the relevant legislation allows processing without the explicit consent of the relevant person (including transfers), and that no processing is carried out without permission.

To Whom and For What Purposes Are Processed Personal Data Transferred?

 

Your collected personal data may be transferred by our Institution to our business partners, suppliers, legally authorized public institutions and private individuals for the following purposes, in accordance with the basic principles stipulated by the KVKK and within the scope of the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK:

  • To be able to carry out work and transactions as a result of signed contracts and protocols.
  • To ensure the fulfillment of legal obligations as required or made mandatory by legal regulations.
  • Carrying out the necessary work by the relevant business units and executing the related business processes,
  • Planning and execution of the services and business strategies provided by our institution,
  • Ensuring the legal, technical and commercial occupational safety of our Institution and the relevant persons who have a business relationship with our Institution,
  • Follow-up of finance, accounting and legal affairs.

 

Storage Period of Your Personal Data

Although no period has been determined for the storage of personal data within the scope of the KVKK, it is essential that personal data be stored for the period stipulated in the relevant legislation or necessary for the purpose for which they are processed, in accordance with general principles. In order to determine the storage periods in accordance with the said principle, our Company makes an assessment based on the legislation in force and the purpose of the process for each data processing process. Accordingly, our Company stores personal data for the period required by its legal obligations at least and in any case until the relevant statute of limitations expires. Our Company anonymizes, deletes or destroys personal data in accordance with the Law when the purpose of processing the relevant personal data is eliminated within the scope of any process, including the expiration of the aforementioned periods. Anonymization within the scope of the Law is defined as “making personal data in no way associated with an identified or identifiable natural person, even by matching it with other data” and our Company carries out its anonymization activities in accordance with the applicable legislation.

Your Rights as a Data Owner and the Use of Rights

As the data owner in accordance with Article 11 of the KVKK;

(a) Learning whether personal data is being processed,

(b) Request information regarding the processing of personal data,

(c) To learn the purpose of processing personal data and whether they are used in accordance with their purpose, (ç) To know the third parties to whom personal data is transferred, either domestically or abroad,

(d) Request correction of personal data if it is processed incompletely or incorrectly,

(e) Request the deletion or destruction of personal data within the framework of the conditions set forth in Article 7 of the KVKK,

(f) In case of correction or deletion/destruction of data, to request notification of the situation to third parties to whom personal data is transferred,

(g) To object to the emergence of a result to the detriment of the person by analyzing the processed data exclusively through automatic systems,

(ğ) You have the right to demand compensation in case of damages due to unlawful processing of personal data.

 

You must submit your requests regarding the implementation of the KVKK to our Institution in writing, either in person or through a notary public or through other methods determined by the Personal Data Protection Board. Our Institution will finalize the requests included in the application as soon as possible, within thirty days at the latest, as of the date the request is received and depending on the nature of the request, and will notify you in writing or electronically. Our Company reserves the right to request a fee based on the fee schedule determined by the Personal Data Protection Board (if any). Protection of Your Information

In order to prevent your personal data from being processed illegally, to prevent illegal access to personal data and to ensure the preservation of personal data, the necessary measures have been taken by our Institution or the relevant organization in the systems and internet infrastructure, within the technological possibilities and cost elements, with appropriate technical and administrative methods, depending on the nature of the information and transaction. Our Institution conducts internal audits within the scope of Article 12 of the KVKK. Necessary information has been provided to our data processing personnel within the scope of the KVKK, and efforts are being made to raise awareness on the protection of personal data.
